SERVICE OF PROCESS
American consular officers are prohibited by regulations from serving legal process emanating from any court, whether in the United
States or abroad, and are prohibited from appointing others to do so, except in certain cases in the United States Federal courts involving
service of process on United States citizens abroad (28USC 1783 and 1784,)
Service of process in the Philippines may be  accomplished by various methods (depending on the circumstances of the case, such as by
registered mail at last known address, by publications, and personal service which may also be made by other officers of the court,
including attorneys.  Most American law firms have found it helpful, and in many cases necessary, to engage the service of Philippine
attorneys to advise and assist them in effecting service of process in the Philippines.2

PhilHealth extends payment deadline in Sendong-affected areas

CEBU CITY, Jan. 7 (PIA) -- The Philippine Health Insurance Corporation (PhilHealth) extends the payment deadline of individually-paying members (IPM) for the fourth quarter of 2011 on Mar. 21, 2011, especially in Sendong-affected areas in the country.

In a press release, PhilHealth gives a three-month extension to give consideration to IPMs residing therein.

Voluntary and self-employed IPMs generally pay on a quarterly basis. Premiums must be paid on or before the last working day of each calendar quarter, so that payment deadline for Oct. to Dec. 2011 should have been in by Dec. 29.

However, Presidential Proclamation No. 303 placed Regions 7, 9, 10, 11 and Caraga under state of calamity due to severe damage caused by Sendong. PhilHealth extended the payment deadline in these regions as a way of helping its members cope with crisis.

Overseas Filipino workers (OFW) and KaSAPI members residing in these regions are also given similar consideration.

Mines and Geosciences Bureau Region-7 identifies 39 barangays in La Liberta and Guihulngan as landslide prone

CEBU CITY, February 10 (PIA) -- Responding to the need of site assessment on the reported earthquake-induced landslide incidents, Mines and Geosciences Bureau (MGB-7) deployed a team of geologists and mining engineers immediately to Negros Oriental specifically in the areas badly hit by the February 6 earthquake.   
MGB-7 regional director Loreto Alburo said this developed after many areas reportedly were affected by the earthquake-triggered landslides following a 6.9 magnitude earthquake that hit the Visayas region.
In its inspection on February 7, the team noted an artificial dam or building up of water in two sites along Tinayunan River in Barangay Tinayunan Beach in Guihulngan City.
It immediately recommended the evacuation of residents downstream of river including evacuees at Tent City in Barangay Tinayunan Beach due to the possibility that the artificial dams could collapse. 
MGB-7 has identified 39 barangays in La Libertad and Guihulngan, Negros Oriental with high and moderate landslide susceptibility ratings on its rain-induced geological assessment.
Alburo urged local government officials to revisit the geo-hazards threat advisory that MGB distributed to them in 2009.
Following the 2009 geological assessment report in Guihulngan City, five barangays--Humayhumay, Imelda, Mabunga, Sandayao, and Tacpao have high susceptibility to landslide.  Barangay Binobohan has moderate to high susceptibility to landslide.  
There are eleven barangays in Guihulngan with moderate susceptibility to landslide and these are Bakid, Banwaque, Calamba, Calupa-an, Linantuyan, Mabunga, Maniak,Plagatasanon, Planas, Trinidad, and Villegas.  
In La Libertad MGB-7 identified nine barangays with high landslide susceptibility which are Aniniaw, Aya, Biga-a, Guihob, Kansumandig, Mambutod, Managondong, Pangca, and Pitogo.  
Barangay Mandapaton has moderate to high susceptibility to landslide.  Eleven barangays with moderate susceptibility to landslide are Manluminsag, Busilak, Cantopa, Elecia (Talostos), Eli, Manghulyawon, Martilo, Nasungon, San Jose, Solongon, and Tala-on.  
 “Although it was a rain-induced assessment, we are seeing now a similar occurrence in an earthquake-induced landslides or ground failure,” Alburo added.
Earthquakes can produce slope instability, tension cracks and fractures that may enhance the vulnerability to landslides.

Close to 900 aftershocks recorded by Phivolcs, Bohol safe 6.9-magnitude earthquake aftermath

TAGBILARAN CITY, Bohol -- The local seismology monitors recorded as much as 900 mild aftershocks as of noontime today after the 6.9-magnitude earthquake hit Central Visayas on Feb. 6.

According to the local Philippine Volcanology and Seismology (Phivolcs), through Engineer Nolan Evangelista, aftershocks are just ordinary incidents after a major earth movement.

Evangelista also shared that the most noticeable aftershocks reached intensity 3 that was recorded at around 6:10 p.m. yesterday and another one at 7:32 p.m., which reached intensity 2.

“There have been numerous aftershocks but most of them were so mild, Boholanos did not seem to notice them. Since these are aftershocks, these are never stronger than the major earthquake, unless another movement is caused by another or a similar fault,” Evangelista added.

He also explained that the Phivolcs has earlier issued intensity reference charts. These charts help ordinary people measure the intensity of the earthquake while looking at the objects shaken by the tremor.

On the other hand, a magnitude scale usually issued by the Phivolcs uses the equipment recorded data which are available in their office.

It means that a magnitude scale reading is a more accurate measurement of the tremor than an intensity scale which can be subjective of one’s personal experience, he said.

Surviving with reports of very mild damages in cracked buildings, Bohol has also shuddered at the tremors that came after.

Over this, school authorities have suspended classes in kindergarten to secondary levels so building officials and Department of Education (DepEd) authorities can inspect the integrity of school structures.

Dr. Lorna Rances, schools division superintendent, urged local and school officials to help assess the damages in school buildings in their areas of responsibility and subsequently issue certifications of safe occupancy of school buildings to DepEd so that classes can resume.

Yesterday, some residents felt worried when text messages about an impending tsunami circulated, after a Phivolcs-issued tsunami warning number 2.

Engineer Evangelista explained that Phivolcs tsunami alert 2 means that there is a certainty that meter high waves do come and that residents in coastal areas are advised to move away from the 20-meter zones from the sea levels for their safety.

It means there is a real possibility that water may rise a meter high, but in yesterday’s case, it should have come to Bohol an hour after the major quake, he said.

He informed that Bohol can only be vulnerable to tsunami if Western Negros fault is the source, and he added that it can only happen when the quake generates a magnitude 7.

In that case, Tagbilaran City and some southern Bohol towns can be affected by meter-high waves.

MANILA, Philippines - A strong earthquake in the central Philippines killed at least 13 people Monday as it destroyed buildings and triggered landslides that buried dozens of houses, trapping residents. At least 29 people were missing.

The 6.8-magnitude quake, in a narrow strait just off Negros Island, caused a landslide in Guihulngan, a city of about 180,000 people in Negros Oriental province. As many as 30 houses were buried and at least 29 people were missing, Mayor Ernesto Reyes said.

"Their situation is bad because if you are covered by landslide for one hour, two hours, how can you breathe?" he said. "But we just hope for the best, that there are still survivors."

Reyes said at least 10 people were confirmed dead in his town, including students at a college and anelementary school and others in a market that collapsed. About 100 were injured.


The quake, which hit at 11:49 a.m. (0349 GMT), triggered another landslide in the mountain village of Solongon in La Libertad town, also in Negros Oriental. An unknown number of people were trapped, said La Libertad policechief inspector Eric Arrol Besario.

"We're now getting shovels and chain saws to start a rescue because there were people trapped inside. Some of them were yelling for help earlier," Besario told The Associated Press by phone. Three key bridges in the town suffered cracks and were no longer passable, he said.

Philippine seismologists briefly issued a tsunami alert for the central islands. Five bamboo and wooden cottageswere washed out from a beach resort in La Libertad by huge waves, but there were no reports of injuries, said police Superintendent Ernesto Tagle. Elsewhere along the coast, people rushed out of schools, malls and offices.

The epicenter was closest to Tayasan, a coastal town of about 32,000 people flanked by mountains in Negros Oriental province. Two died there, including a child when a concrete fence of a house collapsed, said Benito Ramos, head of the Office of Civil Defense.

Another child was killed in a church when a wall collapsed during a funeral in Negros Oriental's Jimalalud town,Mayor Reynaldo Tuanda said.

Tayasan police officer Alfred Vicente Silvosa told The AP by phone that aftershocks were preventing people from returning to their homes. Seismologists recorded nearly 45 aftershocks.

"We are outside, at the town plaza. We cannot inspect buildings yet because it's dangerous," Silvosa said. "I felt the building shaking, so I rushed out of the building. Our computers, shelves, plates, the cupboards, water dispenser all fell."

A three-story office building also collapsed in La Libertad, but occupants managed to run out.

Negros Oriental police chief Edward Carranza said the temblor damaged many houses in Guihulngan and he ordered his men to help displaced residents find shelter.

Officials in some areas suspended work and canceled classes. Power and telecommunications were knocked out in several places.

Carranza said police rushed out of his building when the quake struck. "All my personnel ran out fearing our building would collapse," he said.

The U.S. Geological Survey said the quake was centered 44 miles (72 kilometers) north of Dumaguete city on Negros and hit at a depth of 29 miles (46 kilometers). The area is about 400 miles (650 kilometers) southeast of the capital, Manila.

The Philippines is located in the Pacific "Ring of Fire" where earthquakes and volcanic activity are common. A 7.7-magnitude quake killed nearly 2,000 people in Luzon in 1990.

DSWD-7 sends relief to earthquake victims

CEBU CITY, February 9 (PIA) -- While search and rescue operations continue in earthquake devastated areas  in Negros Oriental, Social Workers from the Department of Social Welfare and Development (DSWD)  in Central Visayas activated its Quick Response Teams.
 
The teams, which have been placed on “Red Alert” status, are tasked to prepare relief goods such as food packs, mats, blankets, mosquito nets, slippers and tents for evacuation centers in Guihulngan, La Libertad.
 
About 30 tents, 330 mats, 318 blankets, 275 mosquito nets , 2,000 bottles of mineral water and 2,000 family packs, 160 boxes of canned goods (sardines and beef loaf) were shipped to the affected  areas yesterday.
 
These goods were initially distributed to the earthquake victims in Guihulngan, which is the hardest hit, La libertad, Bindoy and Tayasan. Delivery for the other areas follows.  
 
As more reports are  coming in, the DSWD is doubling its efforts to pack additional goods for the next round of shipment and relief distribution in the other affected municipalities  in Negros Oriental.
 
DSWD secretary Dinky Soliman reported that so far, an estimated 12,231 families had been affected with 22 confirmed dead, 82 missing and 52 injured as of 3:00 pm today.
 
A magnitude 6.9 earthquake, the strongest recorded in Central Visayas  in 90 years, struck the northern towns in  NegrosOoriental at 11: 49 am February 6.
 
Social Workers both from the Local Government Units and the Social Welfare and Development Team Offices in Negros Oriental conducted  initial defusing sessions to a few  survivors  in the various evacuation centers  temporarily set up for the purpose.      
 
DSWD regional director Ma. Evelyn Macapobre  has instructed her staff to go on a 24/7 duty and had already fielded  stress debriefers to conduct psycho-social intervention to the grieving families.
 
“We are now keeping in touch with all our local counterparts in Negros Oriental to generate updates for provision of augmentation support  especially along relief works," she added.
